HUMM — PRIVACY POLICY
Governing Statement of Data Practices, User Rights, and Information Governance
This Policy is effective upon publication and supersedes all prior instruments of like nature. It is subject to revision at Humm's sole discretion, without notice to the User.

PREAMBLE
WHEREAS, Humm (hereinafter "the Company," "We," or "Humm") doth operate a cloud-based voice dictation and text-processing service (hereinafter "the Service"); and
WHEREAS, the responsible governance of User data doth constitute a matter of material importance to the Company and to those who engage with the Service; and
WHEREAS, the User's relationship with their Voice Data, their usage information, and the contextual metadata generated during use of the Service requires clear and binding articulation of the Company's practices and the User's rights therein;
NOW, THEREFORE, Humm doth hereby set forth this Privacy Policy (hereinafter "the Policy") governing the collection, processing, storage, deletion, and protection of all data arising from the User's engagement with the Service. By accessing or using the Service in any manner, the User doth acknowledge having read and accepted this Policy in its entirety.
ARTICLE I — SCOPE OF THIS POLICY
1.1 This Policy applies to every natural person, legal entity, or organisation that doth access, register for, subscribe to, join any waitlist of, or otherwise interact with the Service, whether through a mobile application, web interface, or any other channel offered by Humm (hereinafter "the User").
1.2 This Policy governs all data practices associated with the Service, including but not limited to the processing of Voice Data, the collection of usage and contextual metadata, the governance of stored transcriptions, and the exercise of User rights over personal information.
1.3 This Policy doth not govern the practices of any third party whose products, websites, or services may be accessed through, or in connection with, the Service. The User is directed to consult the separate privacy instruments of any such third party directly.
ARTICLE II — DEFINITIONS
For the purposes of this Policy, the following terms shall bear the meanings ascribed to them hereunder, and all terms not otherwise defined herein shall carry their ordinary legal meaning:
2.1 "Voice Data" shall mean any audio recording, spoken word, verbal instruction, conversational input, or sonic communication submitted by the User to the Service for processing.
2.2 "The Humm Model" shall mean the artificial intelligence processing system employed by the Service to receive, analyse, transcribe, format, and transform Voice Data into textual output. All references to AI-generated transcription, formatting, translation, and language processing herein refer to functions performed by or through the Humm Model.
2.3 "Usage Data" shall mean records of the User's interactions with the Service, including session frequency, feature activation logs, transcription counts, language preferences, and settings configurations.
2.4 "Display Metadata" shall mean information pertaining to the application or digital environment in which the User is operating at the time of dictation, including but not limited to the name, category, or functional context of the active application, as transmitted by the User's device to the Service for the purposes described in Article VI hereof.
2.5 "Stored Memory" shall mean any Voice Data, transcription output, user-defined preferences, custom vocabulary, or contextual history that the User has elected to retain within the Service's cloud infrastructure.
2.6 "Cloud Infrastructure" shall mean the remote server environment through which all Service functions are executed, it being expressly acknowledged by the User that the Service operates exclusively through cloud-based processing with no offline or local computation of any kind.
2.7 "Third-Party Processing Partners" shall mean external computational infrastructure providers and AI model operators engaged by Humm in the ordinary operation of the Service, pursuant to such contractual arrangements as Humm deems appropriate.
ARTICLE III — THE FOUNDATIONAL PRINCIPLE: YOUR DATA BELONGS TO YOU
Humm doth hold as its governing principle that the User retains ownership, control, and dominion over their data at all times. Voice Data is not a commercial asset of Humm. It is not monetised. It is not sold. It is not shared with advertisers. It is not used for any purpose other than the delivery of the Service to the User who provided it. The User's spoken words and the transcriptions derived therefrom are, and shall remain, the User's own.
No Voice Data, transcription, or Usage Data is collected by Humm for commercial purposes, marketing analytics, model training, profiling, or any purpose beyond the operational delivery of the Service.
While Personally Identifiable Information (PII) — such as the User's name, email address, age, occupation, and contact information — might be used to provide other services offered by the company such as product updates, newsletters, and customised ads.
ARTICLE IV — DATA COLLECTED AND ITS PURPOSE
4.1 Voice Data. When the User speaks into the Service, Voice Data is transmitted to the Service's cloud infrastructure for processing by the Humm Model. This transmission is a technical necessity of the Service's operation. Voice Data is not retained by default upon the conclusion of a processing session unless the User has elected storage, as described in Article V.
4.2 Usage Data. The Service records operational data relating to the User's patterns of use, including session timestamps, features engaged, transcription volume, language selections, and device configuration data. This data is used solely to maintain and improve the User's experience of the Service, to provide support, and to ensure the operational integrity of the platform. It is not disclosed to third parties for commercial ends.
4.3 Display Metadata. For the purposes of context-aware dictation, wherein the Service adapts its transcription output to the specific application or digital environment in which the User is operating, the User's device doth transmit to the Service's servers certain metadata pertaining to the active application. By way of illustration, should the User employ the Service whilst composing correspondence within an electronic mail platform, the metadata pertaining to that platform's context shall be transmitted to the Service. This metadata is used solely to provide accurate and contextually appropriate transcription. It is processed for no other purpose and is not retained beyond the active session in which it is generated, save where retention is expressly elected by the User.
4.4 User Profile and Preferences. Where the User creates an account with the Service, Humm retains information provided at registration — such as name, email address, language preferences, and subscription status — for the purpose of account management, service delivery, billing, and support communications.
4.5 Payment Data. All payment transactions are processed through Humm's designated payment infrastructure. Humm retains transactional records for billing, legal compliance, and dispute resolution purposes. Payment card or banking data is not held by Humm directly; such data is governed by the terms of the applicable payment processor.
ARTICLE V — VOICE DATA STORAGE: USER ELECTION AND CONTROL
5.1 Voice Data is not stored by Humm by default. Upon conclusion of a processing session, Voice Data not elected for retention by the User is expunged from active processing systems.
5.2 The User may, at their election, activate the storage function within the Service settings, whereupon Voice Data and/or transcription output shall be retained within Humm's cloud infrastructure for the period specified by the User.
5.3 Stored data remains at all times subject to the User's authority. The User may, through the mechanisms provided within the Service interface, do any of the following without restriction:
- Delete individual items of Stored Memory at any time;
- Delete all Stored Memory in its entirety at any time;
- Configure an automatic deletion schedule, pursuant to which all Stored Memory shall be permanently removed from the cloud infrastructure after a period of no less than forty-eight (48) hours, or such other period as the User shall designate within the Service settings.
5.4 Deletions effected through the Service interface shall remove the relevant data from Humm's cloud infrastructure. Such deletion shall not, however, extend to any data previously copied, downloaded, or otherwise retained by the User upon their personal device or any other storage medium outside Humm's infrastructure. Data remaining on the User's device is beyond Humm's authority and responsibility.
5.5 Humm doth not archive, back up, or otherwise preserve copies of User Voice Data beyond what is operationally necessary for the active processing session, save in respect of data the User has elected to store.
ARTICLE VI — CONTEXT-AWARE DICTATION AND DISPLAY METADATA
6.1 The Humm Model provides context-aware dictation, a function by which the Service interprets the active application or digital environment of the User's device and applies this contextual knowledge to produce transcription output that is appropriate in terminology, register, and formatting to that environment.
6.2 To enable this function, the Service receives Display Metadata from the User's device. This metadata indicates the nature and identity of the application in active use at the time of dictation. It does not include the substantive content of any document, message, file, or other data present within that application. The metadata is limited to contextual identification information.
6.3 Display Metadata is processed exclusively for the purpose of improving the accuracy and relevance of the Humm Model's transcription output within the User's specific working context. It is not retained beyond the duration of the active dictation session unless the User has elected session storage, and it is not used for any purpose other than that described herein.
6.4 The User may disable context-aware dictation within the Service settings, in which event no Display Metadata shall be transmitted.
ARTICLE VII — TONE-PRESERVED TRANSLATION
7.1 The Service provides a tone-preserved translation function, enabling the User to render spoken input into text in a language other than that in which they spoke, whilst preserving the tone, intent, and communicative character of the original utterance.
7.2 To employ this function, the User must designate a target language within the Service settings prior to initiating dictation. The Humm Model shall then process Voice Data with the explicit instruction to render output in the selected language and in no other. The translation function operates solely upon the language pair constituted by the User's spoken language and the designated target language.
7.3 The tone-preserved translation function shall not operate across languages other than those expressly selected by the User for any given session. Selection of a target language constitutes the User's instruction to the Humm Model and governs the entirety of that session's output.
7.4 Humm makes no warranty that the tone-preserved translation function shall achieve a perfect or unqualified rendering of the User's intended tone across all languages, registers, or communicative contexts. The User is advised to review all translated output before transmission or use.
ARTICLE VIII — COMPUTATIONAL INFRASTRUCTURE, PROCESSING ARCHITECTURE, AND OPERATIONAL LIMITATIONS
8.1 The Service operates exclusively through cloud-based computational infrastructure. All Voice Data processing, transcription, formatting, translation, and contextual intelligence functions are executed remotely. The Service provides no offline, local, or on-device processing of any kind. The User's use of the Service at all times presupposes and requires an active internet connection.
8.2 The Humm Model, in its present form, executes its functions through computational infrastructure and model services engaged by the Company. In the ordinary and necessary course of delivering the Service, Voice Data and associated contextual metadata are transmitted to and processed within server environments that form part of the technical apparatus through which the Humm Model operates, the said server environments being subject to such operational, contractual, and technical arrangements as the Company maintains in the administration of the Service; and the User doth expressly acknowledge and accept — by virtue of their continued use of the Service and their agreement to this Policy — that Humm's responsibility with respect to data processed through third-party computational infrastructure is limited to the exercise of reasonable commercial diligence in the selection and oversight of such infrastructure, and that Humm doth bear no liability, obligation, or responsibility of any nature for any loss, corruption, destruction, unauthorised access, disclosure, or unavailability of data arising within or attributable to any third-party server environment or processing system, whether occasioned by technical failure, system error, negligence of a third party, malicious act, force majeure, or any other cause whatsoever, it being agreed that the Company's obligations in respect of data security are those of reasonable commercial endeavour and not of absolute guarantee, and the User's recourse in respect of any such third-party data event shall be directed to the relevant infrastructure operator in accordance with that operator's published terms, and not to Humm.
8.3 The User acknowledges that the transmission of data across internet infrastructure carries inherent technical risks not within the exclusive control of any single party. Humm employs commercially reasonable security protocols in the transmission and handling of User data but cannot and does not warrant the absolute security of data in transit.
ARTICLE IX — DATA SHARING AND DISCLOSURE TO THIRD PARTIES
9.1 Humm doth not sell, license, rent, or otherwise commercially transfer User Voice Data, transcription output, or Usage Data to any third party.
9.2 User data is not disclosed to advertisers, data brokers, analytics companies, or marketing organisations for any purpose.
9.3 User data is not used for the training of any AI or machine learning model by any party, including Humm.
9.4 Humm may disclose User data to third parties only in the following limited circumstances:
- (a) Where required by a valid and lawful legal order, court directive, or governmental authority of competent jurisdiction, in which case Humm shall disclose only the minimum data required by such order and shall, where legally permissible, notify the User prior to disclosure;
- (b) Where disclosure is necessary to protect the safety of persons in circumstances of imminent serious harm;
- (c) Where disclosure is made to successor entities in the context of a corporate acquisition, merger, or restructuring, subject to the successor entity's assumption of obligations equivalent to those set forth herein.
ARTICLE X — ACKNOWLEDGMENT OF AI LIMITATIONS
10.1 The User expressly acknowledges that the Humm Model, like all artificial intelligence systems, produces output through probabilistic processes and is not infallible. Transcription errors, formatting inaccuracies, mistranslations, tonal misrenderings, omissions, and other imperfections may occur in the output produced by the Humm Model.
10.2 By using the Service, the User accepts and acknowledges that AI-generated output requires human review before use, transmission, or reliance. The User agrees to bear sole responsibility for any consequence arising from their transmission of, or reliance upon, Humm Model output without adequate review.
10.3 Humm doth not warrant the accuracy, completeness, or fitness for purpose of any transcription, translation, or textual output produced by the Humm Model. Humm is not liable for any loss, reputational harm, professional error, contractual failure, interpersonal consequence, or any other damage arising from User reliance upon Humm Model output.
10.4 The User's continued use of the Service shall constitute their ongoing acknowledgment and acceptance of the limitations described in this Article.
ARTICLE XI — USER RIGHTS OVER PERSONAL DATA
11.1 The User holds the following rights with respect to personal data held by Humm, exercisable at any time through the mechanisms provided within the Service interface or by written request to Humm's support function:
- The right to access all personal data held by Humm pertaining to the User;
- The right to request correction of any personal data held by Humm that is inaccurate or incomplete;
- The right to delete all personal data held by Humm, including Stored Memory, account information, and Usage Data, subject to Humm's obligations to retain billing and legal compliance records for such periods as are required by applicable law;
- The right to configure automatic deletion schedules for Stored Memory, as described in Article V;
- The right to update and manage all preferences, stored vocabulary, and contextual information held within the Service;
- The right to withdraw consent to any data processing activity for which consent is the operative legal basis, with the consequence that the affected processing shall cease, though the User acknowledges that certain processing activities are necessary for the delivery of the Service and that withdrawal of consent therefor may render the Service inaccessible.
11.2 Requests to exercise the foregoing rights shall be directed to Humm's support function as published on Humm's official platform. Humm shall respond within a commercially reasonable period.
ARTICLE XII — BETA FEATURES AND DATA HANDLING
Certain features of the Service are designated as Beta Features and remain subject to active development. Beta Features may process data in ways that differ from the handling described in this Policy in respect of stable features, and their operation may be subject to change, interruption, or discontinuation without prior notice. The User employs Beta Features at their sole risk. Humm bears no liability for any anomalous data handling, unexpected output, or loss of data arising in connection with the use of Beta Features.
ARTICLE XIII — CHILDREN
The Service is not directed to persons under the age of eighteen (18) years. Humm does not knowingly collect or process data from persons under this age. Should Humm become aware that a person under the age of eighteen has submitted data through the Service, such data shall be deleted without delay. Parents or guardians who believe a minor has provided data to Humm are directed to contact Humm's support function forthwith.
ARTICLE XIV — REVISIONS TO THIS POLICY
14.1 Humm reserves the absolute right to amend, revise, or replace this Policy at any time at its sole discretion, without prior notice to the User.
14.2 Revised versions of the Policy shall take effect upon publication to Humm's official platform. The User bears sole responsibility for reviewing this Policy periodically to remain informed of its current terms.
14.3 Continued use of the Service following publication of a revised Policy shall constitute the User's acceptance of the revised terms. Should the User find any revised provision unacceptable, their sole remedy is to discontinue use of the Service.
ARTICLE XV — CONTACT AND DATA ENQUIRIES
All enquiries, requests, complaints, or communications pertaining to this Policy or to the handling of User data shall be directed to Humm's support function through the official channel published on Humm's platform. Humm shall endeavour to acknowledge all such communications and to provide a substantive response within forty-eight (48) working hours, where "working hours" shall mean the standard business hours observed by Humm, exclusive of weekends and recognised public holidays.
ARTICLE XVI — GOVERNING LAW
This Policy shall be governed by and construed in accordance with applicable law. Any dispute arising under or in connection with this Policy shall be subject to the exclusive jurisdiction of such courts as Humm shall designate.
This Privacy Policy constitutes the entire and authoritative statement of Humm's data practices with respect to the Service. No verbal representation, informal communication, or supplementary statement by any person acting on behalf of Humm shall be construed to alter, supplement, or contradict the provisions hereof.
BY USING THE SERVICE, THE USER CONFIRMS THAT THEY HAVE READ, UNDERSTOOD, AND ACCEPTED THIS PRIVACY POLICY IN ITS ENTIRETY.
